Who Is Responsible for the Mortgage After A Quit Claim Deed Is Signed?

Before a divorce can be final in California, couples are required by the court to equally divide all community property, such as bank accounts, personal vehicles, furniture, retirement accounts, pension plans, etc., as well as debts, such as mortgages, car loans and credit card debts, Under California law, separate property debts and assets (usually acquired before or after the marriage) are assigned to the spouse responsible for them. Community property assets and debts must be divided equitably between both spouses. That applies to any real estate or personal property, including the family home, acquired during the length of the marriage. During the divorce, the family home can either be sold, or kept by one of the spouses. Usually, the spouse who agrees to keep the family home will be required to financially compensate the other spouse by “buying out” their share of the house, or relinquish other personal property of equal value.

The spouse who wants to keep the family home will also ask the other spouse to sign a Quit Claim Deed. This removes one spouse’s name from the property title and gives full ownership to the spouse keeping the home regardless of a mortgage or lien. If the house is sold later on, only the spouse whose name is on the home title will be entitled to any proceeds, even if the home’s equity accrued after the divorce. It is very important to realize that, while a Quit Claim deed strips a spouse from all rights of ownership, it does not absolve his/her responsibility for the mortgage. As long as that spouse’s name is still on the mortgage papers, he/she may still be responsible for making loan payments. If the other spouse stops making mortgage payments after the divorce, the mortgage company can take legal action against anyone named on the joint mortgage. That is the reason why the judge normally requests the spouse keeping the family home to refinance the mortgage and remove the other spouse’s name from the loan. As an alternative the spouse keeping the property will provide a “hold harmless” clause in the Marital Settlement Agreement assuring the party relinquishing title that they will “protect” the transferor from any liability should the purchaser fall behind on payments.

Additionally, if the mortgage was in arrears before the Quit Claim Deed was signed, both spouses are responsible for the debt. This means that the spouse who relinquishes the family home will have to settle the debt with the mortgage company before the joint mortgage can be refinanced as a single mortgage. As for property taxes, once a spouse signs a Quit Claim Deed and does not own the house anymore, he/she will not be responsible for any new tax debt accrued after the Quit Claim Deed was signed. However, he/she can still be held responsible for any taxes that were due at the time the deed was signed. This is why it is best to pay off any outstanding debt, such as taxes, at the time the Quit Claim Deed is signed.

Dividing community property during a divorce can be complex and overwhelming for many couples. For much less than the cost of litigation, an experienced divorce mediator can help spouses divide community property and debt fairly and equitably, and solve any other issues, such as child custody, child support, and spousal support.

Marriages can be monogamous, polygamous, polygynous, polyandrous, inter caste, arranged or hyper-gamy. Of course, love marriages occur more frequently with the liberalization of societies where people prefer to select their own partner. No matter what type of marriage one may be in, it is not a bed of roses as one might assume.

Working on the marriage
Hence, marriage is to be worked at in order for it to be successful. It is a relationship between the 2 persons who are committed to each other’s happiness. Simple actions and a kind word can boost up its health barometer such as taking out the garbage on your own initiative, buying a special lingerie for her birthday, flowers and chocolates of her liking, a pleasant surprise, some intimate moments together, communicating patiently, loving the crazy ideas and behavior, able to view partner’s faults with a twinkle in the eye and forbearing with each other’s idiosyncrasies.

It is quite normal for a marriage to start off well, but as the years go by, the sparks tend to fizzle out. Hence, one must learn to work on it to keep the sparks constant as with any fire analogy. When one or the other party in slacks at working on it, it is headed for trouble. But there are many simple alternatives to spice up like a romantic dinner or a special night just for the two of you.

High IQ And The Thirst For Knowledge

Einstein once said that curiosity was his friend and his memory was a faithful servant. Okay so, what’s more important; the question or the answer? Well, my friend I will submit to you, it depends on who you ask. For if the person you ask is you, then the question is more important, because the simple asking of a question sends you on a journey to seek out the answer and discover new things, for which more questions emerge. This is how an active high IQ mind works. Let’s talk shall we?

You see, this topic came up a couple of years ago at our think tank, and Mark who is a genius in his own right told me; “I have no idea why my mind wants to have all this information. I’ve always been curious my whole life but I never thought that just a simple trip outside would require so much thought.”

It doesn’t ‘require’ so much thought, but his mind enjoys the process, so it just runs away with it. Nothing wrong with taking curiosity and coupling it with imagination – plus belief, creating a world within a world, hey did you see the movie “Limitless” and “Inception” kind of reminds me of all that, with a little “Matrix” in the mix – pretty cool.

To my reader so you can follow along, here is some advice to get into the curiosity mode. You might try this; pick up package, read the ingredients then try to back imagine the supply chain, from the crops in the field, to the tractors used, to the rubber, steel, and hydraulic systems on it, to who made them, where did the come from, to the iron ore mines, to the rubber vulcanization plant, to the GPS maker running the electronic hardware inside the combine harvesting the wheat, to the seeds, the labs designing the seeds, to the BMW the guy in the lab drives, to his home, his college aged kids, their friends, and their family, to the lady standing next to you. How many degrees of separation is she, are you, from that product you are holding in your hands?

That’s what I do. I look at people and put together their life stories, guess their profession, what brought them there, what they are thinking, based on body language, facial expressions, clothes, shoes, etc. It is amazing how good you can get at this, and what if you went into their life a little more, asked them questions and found out you were dead on in your estimation? It happens to me all the time.

Try this too on your next walk, look at a commercial building imagine the inside, layout, furniture. How accurate do you think your projections are of the room, lighting, temperature, air flow, furniture of those rooms, buildings, businesses are as you walk down the street? You might be surprised how close your estimates are. Maybe there is a possibility to ride a brain wave onto the photons flowing through the window? Next, enter the building see how close your predictions are, hone your skills, and refine your predictions and probability judgments in your mind, it will be easy to remember when you were wrong and when you were right.

Try it, you will be amazed – curiosity is a wonderful attribute for a high IQ, fast processing mind.

The Force Driving the Next Bull Market

One of my father’s goals was to own a house. He’d lost his mother when he was 3 years old and his father when he was 20. Since then, he had been out on his own… renting or staying with whomever would take him in.

In India, owning a house means you belong to a place. The first thing my father did when he started to earn enough money was to build a house.

This feeling of belonging through owning a home is part of American culture as well. Every U.S. generation, when it reaches its peak earning years, follows through on this feeling.

But homeownership is at a 50-year low because of the real estate bubble in the late 2000s and the economic hardship from the financial crisis in 2008.

However, there’s a secret force – people now in their prime earning years – that will change this. And I believe it’s going to make stocks related to home buying and real estate soar.

That group is the millennial generation – which is bigger than the baby-boomer generation with 92 million members. The oldest of the millennials turned 34 in 2016, which marks the point when people begin their years of maximum earning power.

And like every other generation, millennials will spend their money on cars, food, entertainment, etc.

But one of the biggest purchases they can make – one that will have a huge impact on the overall economy – is to buy a home. In fact, online real estate firm Zillow says that millennials account for 48% of all homes purchased today.

That’s why U.S. housing starts in October climbed 25.5% – the highest reading since August 2007 and the largest increase since July 1982.

Playing the Housing Boom

I believe that betting on millennials buying housing is like shooting fish in a barrel right now. That’s why I’ve been telling you to buy the iShares U.S. Home Construction ETF (NYSE Arca: ITB) in my articles since February.

The exchange-traded fund (ETF) owns all the big homebuilders such as Lennar and Toll Brothers, as well as shares of retailers Home Depot and Lowe’s, paint company Sherwin-Williams, furniture company Ethan Allen and many others that benefit from increasing home sales.

Now, if you’d bought this ETF when I first recommended it on February 18, you’d already be up 22% – ahead of the broad market’s gains of 18% over the same time period.

As strong as the performance of this ETF is right now, many housing-related stocks have done far better. For example, a small-cap home building company Hovnanian (NYSE: HOV) is up nearly 100% in the last two months.

USG Corporation (NYSE: USG) is another small company that dominates the drywall industry in the U.S. Its shares are up 36% in the last two months. (Note that Warren Buffett’s company Berkshire Hathaway owns 27% of USG.)

The Next Bull Market

Now, I believe that you’ll beat the bull market by buying the Home Construction ETF I’ve been telling you to buy.

However, if you want to make life-changing gains that can give you financial freedom, you have to find stocks with the potential to go up 300%, 500%, 1,000% or even more.

That may seem unimaginable today, but just remember that the last time we had a massive generation coming of age was 1982 with the baby boomers. That generation created a bull market that lasted until 2000… and generated winners such as Cisco Systems that went up by 40,000%.

I believe the millennials bull market is going to be bigger… and there are going to be astonishing winners just like Cisco coming in the years ahead.
